If you’re renting in England right now, or planning to, there’s a landmark piece of legislation you need to know about. From 1st May 2026, the Renters’ Rights Act comes into full effect, and it represents the biggest shake-up to the rental market in a generation.

What Is the Renters’ Rights Act?
The Renters’ Rights Act is a major piece of government legislation designed to make renting fairer, more stable, and more transparent across England. It shifts the balance firmly in favour of tenants – giving renters stronger protections, greater security, and more say over their homes.
In short: the era of short-term, uncertain renting is coming to an end.
The Key Changes Coming Into Effect:
The end of “no-fault” evictions
Perhaps the most significant change is the abolition of Section 21 – the legal mechanism that allowed landlords to evict tenants without giving a reason. From 1st May, landlords must have a legitimate, evidenced ground to end a tenancy. This is a huge win for renters and means you can settle into your home with real peace of mind.
Rolling tenancies become the norm
Fixed-term tenancy agreements will largely be replaced by periodic (rolling) tenancies. Rather than being tied to a set contract end date, your tenancy simply continues month to month. This gives you greater flexibility to move when life demands it, without the pressure of renewal deadlines hanging over you.
Rent increases – once a year, with notice
Landlords will be limited to one rent increase per year, and must provide proper advance notice before doing so. Crucially, tenants will also have the right to challenge any increase they believe is above market rate. If you feel your rent rise isn’t justified, you now have a formal mechanism to push back.
No more rental bidding wars
Landlords and letting agents will be prohibited from accepting offers above the advertised asking rent. This puts a stop to the informal bidding wars that have become increasingly common in competitive markets, making the process fairer and more transparent for everyone.
Limits on upfront payments
Large upfront rent payments, sometimes used to bypass affordability checks, will be banned. Payments will typically be capped at one month’s rent in advance, making it significantly easier to access a good property without needing a large lump sum at the outset.
Stronger rights across the board
Beyond the headline changes, the Act also introduces the right to request a pet (which landlords must consider reasonably), stronger protections against discrimination for families and those in receipt of benefits, and tougher penalties for landlords who fail to comply.

- Know your rights. Familiarise yourself with what landlords can and cannot do under the new rules – particularly around evictions and rent increases. The more you know, the more confidently you can act.
- Keep clear records. Hold on to copies of all tenancy agreements, correspondence, and any notices you receive. Good documentation is your best friend if a dispute ever arises.
- Check any rent increase carefully. If your landlord proposes a rise, take the time to research local market rates. You now have a legal right to challenge anything that feels disproportionate.
- Embrace the flexibility of rolling tenancies. Rather than viewing the shift away from fixed terms as uncertainty, see it as freedom – the ability to plan your life on your own terms rather than around a contract end date.
- Work with an agent you trust. In a more regulated market, the quality of your letting agent matters more than ever. Compliance, transparency, and good communication aren’t optional extras – they’re the baseline.
