1. Promoter
- The promoter of this referral promotion (the “Promotion”) is Wetlands Property, a trading name of Wetlands Group Limited (Company No. 16677630), registered in England & Wales with registered office at 193 Castelnau, London, SW13 9ER (“Wetlands”, “we”, “us”, “our”).
Wetlands Property is:
• Registered with the Information Commissioner’s Office (ICO No. C1791619);
• A member of the Property Redress Scheme (PRS Membership No. PRS054108); and
• A member of Client Money Protect (CMP Membership No. CMP014990, Expiry 26/02/2027).
This Promotion is operated in accordance with applicable UK law, including the Estate Agents Act 1979, the Consumer Protection from Unfair Trading Regulations 2008, and the UK General Data Protection Regulation (UK GDPR).
2. The Wetlands Referral Reward
- Wetlands Property (“Wetlands”) offers a referral reward to individuals who introduce a property owner (the “Client”) to Wetlands, where that introduction results in a successful sale or letting of the property. The reward is provided as a gesture of appreciation for a genuine introduction that leads to a completed transaction.
3. Eligibility
- The referrer must be over 18 years of age.
- The introduction must be made directly to Wetlands prior to any instruction being agreed.
- The property owner must not already be in discussion with Wetlands at the time of introduction.
- The referrer must obtain the property owner’s consent before sharing their details.
- Only one reward is payable per property.
4. Lettings Referral Reward
- The landlord formally instructs Wetlands on a Sole Agency basis;
- Wetlands successfully secures a new tenant;
- A tenancy agreement is signed;
- The tenant has moved into the property; and
- Wetlands’ letting fee has been paid in full.
- Where the landlord chooses a multi-agency instruction, any reward shall be entirely at the discretion of Wetlands.
5. Sales Referral Reward
- The vendor formally instructs Wetlands on a Sole Agency basis;
- Contracts are exchanged on a sale arranged by Wetlands;
- The transaction completes; and
- Wetlands’ sales commission has been paid in full.
- No reward is payable where the sale does not reach completion.
6. Reward Payment
- The referral reward is a £100 Amazon or Marks & Spencer (M&S) voucher, unless otherwise agreed in writing.
- The voucher will be issued within 14 days of completion (sales) or tenant move-in (lettings), subject to receipt of our full fee.
- Wetlands reserves the right to supply the voucher in digital or physical format.
- The reward is non-transferable and carries no cash alternative.
7. Disclosure Requirement
The referrer must inform the property owner that they may receive a referral reward from Wetlands if the property owner instructs Wetlands and a transaction completes. This ensures transparency and compliance with consumer protection regulations.
8. Exclusions
- The property owner was already known to Wetlands or previously introduced.
- The instruction is withdrawn prior to completion.
- Fees are discounted or written off.
- The transaction does not complete.
- The introduction is deemed not to have materially influenced the instruction.
- Wetlands’ decision regarding eligibility shall be final.
9. General
- The property owner remains entirely free to appoint any agent of their choosing.
- The referral reward does not create any partnership, agency, or joint venture between Wetlands and the referrer.
- Wetlands reserves the right to amend or withdraw this referral scheme at any time without notice.
- These terms are governed by the laws of England and Wales.
10. Exclusions
- No Reward will be payable where:
- The landlord declines to instruct Wetlands;
- The property is withdrawn from the market;
- The landlord proceeds with another agent;
- The tenancy is not completed within 6 months of the referral date;
- The referral information provided is inaccurate, misleading, or fraudulent.
Wetlands reserves the right to withhold payment where it reasonably suspects abuse, collusion, fraud, or misrepresentation.
11. Professional Standards and Transparency
- This Promotion does not alter Wetlands Property’s professional duties under estate agency legislation or PRS rules.
- Any instruction received from a landlord will be subject to Wetlands’ standard Terms of Business.
- The Reward is funded entirely by Wetlands Property and is not deducted from the landlord’s agreed fee unless expressly disclosed.
12. Data Protection
- By submitting a referral, the Participant confirms that they have obtained the landlord’s consent to share their contact details with Wetlands Property.
- Wetlands Property will process personal data in accordance with UK GDPR and its Privacy Policy (available on our website).
- Wetlands may contact the Referred Landlord once to explore potential instructions. The landlord may opt out at any time.
13. Tax
- Participants are responsible for any personal tax liability arising from receipt of the Reward.
14. No Employment or Agency Relationship
- Participation in this Promotion does not create any partnership, agency, employment, or joint venture relationship between the Participant and Wetlands Property.
15. Limitation of Liability
- To the fullest extent permitted by law, Wetlands Property shall not be liable for any indirect or consequential loss arising from participation in this Promotion.
16. Variation and Withdrawal
- Wetlands Property reserves the right to amend, suspend, or withdraw the Promotion at any time.
- Any valid referral submitted prior to withdrawal will be honoured in accordance with the Terms in force at the time of submission.
17. Governing Law
Any disputes shall be subject to the exclusive jurisdiction of the courts of England & Wales. These Terms are governed by the laws of England & Wales.
